Under What Circumstances Can a Person Be Granted Bail?
Whether bail can be granted depends upon the nature of the offence. Bailable offences generally allow bail as a matter of right, whereas non-bailable offences require the discretion of the Court.
In serious offences such as murder, rape, kidnapping, forgery, dowry death, criminal breach of trust, grievous hurt, or attempt to murder, obtaining bail can be more challenging. If you anticipate arrest, it is advisable to immediately consult an experienced criminal lawyer and apply for anticipatory bail.
If anticipatory bail is not granted, your lawyer may seek interim protection and subsequently pursue regular bail before the appropriate court. If the lower court rejects your bail application, you may challenge the order before the High Court.
Types of Bail
1. Anticipatory Bail
Anticipatory Bail is filed under Section 438 of the Criminal Procedure Code (CrPC). It is commonly known as pre-arrest bail and is available to a person who reasonably apprehends arrest.
2. Regular Bail
Regular Bail is generally filed after the arrest has been made before the Sessions Court or the High Court, depending upon the nature of the offence.
Rights of an Arrested Person
• Right to remain silent.
• Right not to be detained for more than 24 hours without being produced before a Magistrate.
• Right to know the grounds of arrest.
• Right to apply for bail.
• Right to consult and be defended by a legal practitioner.
• Right to medical examination.
• Right to inform a friend or family member about the arrest.
• Right to communicate with the Magistrate.
• Right to produce evidence in defence.
These rights are guaranteed by law and play an essential role in ensuring a fair criminal trial.
